General Terms and
Conditions
Fitness For Purpose - Products and services supplied by 3TH are warranted only to conform to the generally recognised standard for the item or service and to pass industry standard diagnostics. If you need a full written spec before purchasing we will do our best to provide it for reasonable size orders. Because of the nature of the PC architecture it is possible (and common) to create circumstances where a fully functional item will not work effectively in the customer's specific environment, under such circumstances the conditions of exchange and or refund will be as per specified for the Service Level of purchase.
Software - Except where media supplied is damaged or unreadable 3TH's sole liability will be to pass on any error corrections supplied to 3TH by the manufacturer. If 3TH is unable to replace damaged media, then we reserve the right to refund the price paid to 3TH for the software. If the software in question is free or shareware then there will be no compensation. Customers must assume that demo programs, shareware and free items are likely to have bugs.
Loading of Software - Unless software is ordered from 3TH (operating or application) or 3TH has agreed to load free software (e.g. a LINUX version) it must be assumed that a system supplied will have a blank hard disk. Where software is supplied (chargeable or free) and 3TH loads such software as part of a system sale then 3TH will use the software vendors default setup and will make reasonable efforts to make sure that hardware is correctly configured. 3TH will not be responsible for any lack of functionality resulting from following this procedure.
Upgrades - If you buy a Server/PC/ a kit/ a motherboard/a barebone from us you can buy upgrades from us or from any other supplier. Additionally you can move parts around that we sold you - at your own risk. Adding upgrades, purchased from other suppliers, does not invalidate the guarantee on the original parts we supplied. Similarly if you only buy part of a system from us we will give you what advice we can on our bit if it will not work. .
We will however make a charge if it takes us longer to resolve a warranty etc problem made more complex by an upgrade not sold by us or by the fact that you have moved a part sold by us from one system to another For example, if we have to resolve a problem in a PC which contains a network card not supplied by us we will either remove the card or charge you for extra time. If we take the card out and the PC works, we will charge you for the time we spent.
In summary - buying a part/upgrade from someone else or moving parts around that we sold you, does not in general invalidate your warranty -but we will charge you if it costs us time or money
Naturally we can not be liable for things like - damage caused to the parts we supplied resulting from defects in, or unsuitability of, add-ons we did not supply, over loading the power supply by adding too many items, running a computer in a room which is too hot etc.
Price Variation - Prices for computer products and services are subject to continual variations due to such factors as change in currency rates, import duties, shortages, changes in technology etc. Until an order is placed and accepted by 3TH Ltd, 3TH Ltd reserves the right to change any price unless a formal quotation has been issued by 3TH. If a formal quotation has been issued and there is no time limit specifically stated on it then it may be assumed that the validity is 30 days. Once an order is placed and accepted by 3TH Ltd, the price will be firm until delivery, provided the agreed delivery date is within 14 days of the order being placed and the cost price of the item does not change by more than 10%. or the cost price to 3TH exceeds the agreed selling price. If 3TH Ltd requests a price increase, in one of these situations, after an order is agreed , then the customer may cancel the order without penalty.
Title on goods supplied by 3TH does not pass to purchaser until full payment is received by 3TH Ltd. Where a customer has an account with 3Th Ltd and the customer's account has become more than 60 days overdue 3TH reserves the right to withdraw any warranty obligations to the customer until the account is settled.
Cancellation - Once an order has been accepted by 3TH Ltd and provided it has not been dispatched/fulfilled, the customer may normally cancel the order without penalty. Exceptions are basically where the customer cancelling the order costs us money i.e. - a. Where 3TH Ltd has had to order the product specially for the customer. If the customer cancels the order, customer will be liable to a minimum charge of 10% of the order value plus an additional 10% of the order value for every month 3TH Ltd is unable to dispose of the item for the same price as the agreed selling price.. b. Where 3TH Ltd has done preparatory work specifically for the customer. In this case customer will be liable for labour at £50 per hour plus any materials used (or at the rate for the specific job, if this is higher). c. If 3TH Ltd has reserved stock for a specific order and as a result has had to turn away business. In this situation customer will be liable for 20% of the order value - however 3TH Ltd will be obliged to provide evidence of the lost business.
Cancellation by 3TH - If an order is cancelled by 3TH, then any payments made by Customer to 3TH Ltd for the order will be refunded. Unless 3TH has agreed to specific cancellation terms in writing and such document has been signed by a Director of 3TH, 3TH will not be liable to any compensation of any type or any consequential or damages if it is unable to fulfil an order.
Our guarantee (at all service
levels and for all goods and services supplied by 3TH LTD) naturally does
not cover damage due to static electricity, lightning, mains voltages surges,
abuse, accidental damage due to dropping items, spilling coffee on keyboards,
etc.,
Provision of Support and Warranty Services Any timescales specified are targets and 3TH is not responsible for the effects of delays or failure to achieve such targets.
Customer's items in our care - If we have a customer's item (computer, printer etc) on our premises and it is stolen or damaged by fire, flood etc then 3TH will replace the item by an equivalent item in equivalent condition or provide compensation at the current market value of the item. The item may not be replaced by an identical one. If the item is special in some way (e.g. an item of special equipment, or an old item that can not be replaced) then, unless agreed otherwise, customer must cover the risk of the item being lost, stolen or damaged themselves. 3TH will not be liable for damage during repair etc caused by equipment being in an unfit state to be worked on. Under no circumstances will 3TH be liable for any loss of data, lost work or time etc caused by loss or damage to equipment we have in our care or are repairing on or outside the customer's premises.
If an item is in our care and the customer does not collect the item within 2 months of 3TH notifying that the item should be collected, then 3TH reserves the right to sell the equipment and hold the proceeds for the customer for a period of one year or if the equipment has no significant market value to dispose of the equipment. By notify we mean make three attempts to contact the customer on any telephone number we have been left or two letters to the last known address. If we have no contact details for the customer the right to dispose will take effect 10 weeks after the date we received the equipment.
Consequential Damages The limit of our liability, under any circumstances, is the selling price of the goods or services we sold to you. We will not be held liable for any consequential damages whatsoever including damage to upgrades or items not purchased from us, loss of data, time, business or work, personal injury etc.
